1. Acceptance of Terms

By accessing or using Efata ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all visitors, users, and others who access or use Efata.

2. Description of Service

Efata is an AI-powered design asset extraction platform that allows users to upload design files and images to automatically isolate, extract, and download individual visual elements and layers. The Service is provided for personal and commercial creative use.

3. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree to use Efata only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

• Upload designs, images, or content that you do not own or do not have the right to use.
• Use the Service to extract assets from copyrighted works without appropriate authorization.
• Attempt to reverse-engineer, decompile, or otherwise interfere with the Service.
• Use automated tools to access the Service in ways that place unreasonable load on our infrastructure.
• Upload content that is illegal, harmful, obscene, or violates any applicable laws or regulations.

5. Intellectual Property

You retain full ownership of all designs and files you upload to Efata. We do not claim any ownership rights over your content. By uploading content, you grant Efata a limited, non-exclusive licence to process your files solely for the purpose of providing the extraction service.

The Efata platform, including its name, logo, interface, and underlying technology, is the intellectual property of Efata and its licensors. You may not copy, modify, or distribute any part of the platform without prior written permission.

6. AI Processing & Accuracy

Efata uses artificial intelligence to analyse and extract design elements. While we strive for high accuracy, the Service is provided on an "as is" basis and results may vary depending on the complexity and quality of uploaded designs. We do not guarantee that all extractions will be perfect or complete.

7. Data Retention

Uploaded files are processed and temporarily stored to generate extraction results. We do not permanently store your original design files beyond what is necessary to provide the Service. Extracted assets are made available for download for a limited period after processing. Please refer to our Privacy Policy for further details.

8. Limitation of Liability

To the maximum extent permitted by law, Efata shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you for any claims arising under these terms shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if you breach these terms or if we reasonably believe your use of the Service is harmful. You may also delete your account at any time from your account settings.

10. Changes to These Terms

We may update these Terms of Service from time to time. When we do, we will revise the "last updated" date at the top of this page. Continued use of the Service after any changes constitutes your acceptance of the new terms.
